Welcome to ZAG STORE. These Terms of Service (“Terms”) govern your use of our website zagstore.com (the “Site”) and any purchase you make on the Site. By accessing or using the Site, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use the Site.

2. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms.
You must not:

• Use the Site in any way that violates applicable law or regulations
• Attempt to gain unauthorized access to the Site or its systems
• Use the Site to infringe any intellectual property or other rights of ZAG STORE or third parties

We reserve the right to refuse service to anyone for any reason at any time, as permitted by law.

3. Products and Availability

All products offered on the Site are subject to availability.
Certain products are limited edition or collector items. Where applicable, this will be indicated on the product page.

Due to the hand-painted nature of our figurines and collectibles, minor variations in color, finish, or detail may occur from one item to another. These variations are normal and are not considered defects.

We reserve the right to modify, discontinue or change any product or price at any time without prior notice.

4. Prices, Payments & Currencies

All prices on the Site are listed in US dollars (USD) unless otherwise specified.

Payment is due in full at the time of order, using one of the secure online payment methods available at checkout, including (but not limited to):

• Mastercard
• American Express (Amex)
• PayPal
• Apple Pay
• Google Pay

Payments are processed via Shopify Payments and other integrated providers. We do not accept cash, checks, or other offline payment methods.

5. Orders, Cancellations & Modifications

Once you place an order, you will receive an email confirmation. This email confirms that we have received your order but does not guarantee acceptance. We reserve the right to refuse or cancel any order, for example in case of suspected fraud, incorrect pricing, or inventory issues.

You may request to cancel or modify your order only if it has not yet been prepared or shipped. Once the order has been processed by the warehouse, it can no longer be changed or cancelled.

If a product is unavailable after your order is placed, we will contact you to propose an alternative or a store credit, or to cancel the order.

6. Shipping & Delivery

We ship from our warehouse in Ontario, California (USA) to many countries worldwide, using carriers such as USPS, UPS, DHL, and others.

Shipping costs and options are displayed at checkout and may depend on your delivery address, total order weight, and carrier.

Shipping fees:

• USA:
• Free shipping for orders of $85 or more (products value)
• Flat rate of $9.95 for orders below $85
• Most countries (over 200 destinations):
• $20 shipping for parcels up to 3 kg (estimated delivery 1–3 weeks)
• $40 shipping for parcels above 3 kg
• Japan, Australia, New Zealand, Hong Kong, South Korea:
• Up to 2.3 lb: $40
• Above 2.3 lb: $99

We do not ship to the following countries/territories:
Morocco, India, Israel, Kuwait, Qatar, Saudi Arabia, Türkiye, United Arab Emirates, Vietnam, Belarus, Bulgaria, Italy, Romania, Russia, Serbia, Spain, Ukraine, Costa Rica, El Salvador, Guatemala, Mexico, Argentina, Brazil, Chile, Colombia, Ecuador, Peru, Venezuela.

Delivery times are estimates only and may vary depending on the carrier, destination, and customs procedures. ZAG STORE is not responsible for delays caused by the carrier, customs, strikes, or other events beyond our control.

7. Customs, Duties & Taxes

For customers in the USA, applicable sales taxes are calculated and shown at checkout.

For international customers, your order may be subject to import duties, customs fees, and local taxes imposed by your country. These charges are not included in our prices or shipping fees and are the customer’s responsibility.

You are responsible for complying with the laws and regulations of your country and for paying any additional charges related to customs clearance.

8. Preorders

Some products may be offered as preorders. When you place a preorder:

• You are charged in full at the time of the order
• The estimated release or shipping dates indicated on the product page are indicative only and may change
• Your preorder will be shipped once the product arrives in our warehouse

If a significant delay occurs, we will do our best to notify you by email.

9. No Returns – No Refunds (to the fullest extent permitted by law)

Due to the collector and limited-edition nature of our products, and to prevent speculation and abuse, we do not accept returns, exchanges, or refunds, except in cases of damaged or defective products as described below, and only to the fullest extent permitted by applicable law.

10. Damaged or Defective Products

If you receive a product that is damaged or defective, you must notify us within 7 days of receipt by emailing contact@zag-store.com, including:

• Your order number
• Clear photos of the product and packaging
• A description of the issue

Our customer service team will review your request and may, at our discretion, offer:

• A replacement (if stock is available), or
• A store credit / voucher

Minor variations in paint or finish, due to the hand-painted nature of the products, do not constitute defects.

11. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, product designs, trademarks, and layout, is the property of ZAG STORE and/or its licensors and is protected by intellectual property laws.

We hold official licenses for all Miraculous™ and other branded products sold on the Site.

You may not reproduce, distribute, modify, create derivative works from, or exploit any part of the Site or its content without our prior written consent.

12. Limitation of Liability

To the maximum extent permitted by law, ZAG STORE shall not be liable for:

• Any indirect, incidental, consequential, or special damages
• Any loss of profits, revenue, data, or goodwill
• Any damages arising from your use of, or inability to use, the Site or products

Our total liability for any claim related to a product or an order shall not exceed the amount you paid for that product or order.

Nothing in these Terms limits any rights you may have under mandatory consumer protection laws.

13. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

14. Changes to These Terms

We may update or modify these Terms from time to time. Any changes will be posted on this page with an updated “Last updated” date. Your continued use of the Site after such changes constitutes your acceptance of the new Terms.

These Terms are governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law principles.

Any disputes arising out of or in connection with these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts located in California, USA, to the fullest extent permitted by law.
